EU Puts ChatGPT Under Strictest DSA Search Rules
On 31 August 2026 the European Commission designated ChatGPT a Very Large Online Search Engine under the DSA, adding it to a 28-service roster with Reddit and Roblox.

The European Commission on 31 August 2026 designated ChatGPT a Very Large Online Search Engine under the Digital Services Act, folding OpenAI’s chatbot into a roster that now covers 28 platforms and search engines. The same announcement labeled Reddit and Roblox Very Large Online Platforms after they passed the 45 million average monthly European Union user threshold. OpenAI, Reddit, and Roblox now face extra duties on systemic risk, advertising, and algorithm transparency, with noncompliance fines of up to 6 percent of global annual revenue.
What the DSA very large labels actually require
A Very Large label is a legal trigger, not a marketing badge. Under the Digital Services Act, online platforms and search engines enter the strictest layer once they reach at least 45 million average monthly users in the EU. That layer requires documented assessments of systemic risks, tighter limits on advertising, and more public detail about how recommendation algorithms work. The Verge’s Emma Roth reported that ChatGPT’s risk file includes effects on minors, user mental health, and the spread of illegal content. Politico also listed election integrity and public security among the harms companies must assess and mitigate.
The same statute already bars targeting ads at minors and using a person’s sexual orientation, religion, ethnicity, or political beliefs for targeting. Those rules now apply with extra Commission supervision because ChatGPT, Reddit, and Roblox sit in the Very Large cohort. OpenAI was already inside the EU Artificial Intelligence Act for general-purpose models. The DSA designation is a second track: it regulates ChatGPT as a mass-reach search service, not only as a model. Related PromptCrates reporting on Texas Governor Greg Abbott’s freeze of state Flock AI camera funding is a reminder that AI products now face public-law fights in more than one jurisdiction at once.
For compliance teams, the designation also changes who sits across the table. Very Large status puts the European Commission in direct supervision of the extra duties, rather than leaving the heaviest questions only with national digital-services coordinators. That does not erase local complaint desks, but it does mean OpenAI’s ChatGPT search file, Reddit’s ranking file, and Roblox’s youth-safety file will be read in Brussels on a timetable measured in months, not in a vague multi-year AI Act workplan alone.
How ChatGPT, Reddit, and Roblox crossed the line
Politico wrote that officials had watched ChatGPT’s user numbers since OpenAI cited about 120 million users last year, and that Brussels had to decide whether the chatbot was a search engine or a platform. OpenAI spokesperson Oscar Haines said ChatGPT search operates as a search service under the DSA and that the company is preparing to meet the extra Very Large Online Search Engine requirements. That statement matches the Commission’s search-engine label rather than a platform label, and it is the most important company comment on classification in this news cycle.
User counts, not brand category, decided the other two files. Reddit reported 57.2 million EU users in July. Roblox reported 46.6 million. Both cleared 45 million and became Very Large Online Platforms. Reddit spokesperson Jen Molina said the company has been preparing for VLOP duties and will coordinate with EU regulators while providing transparency for users. Roblox Europe general manager Joost Hagesteijn said Roblox is proud to be the first gaming platform to reach the milestone and that safety is foundational to everything it does. Those comments do not pause the clock.
What the designation means across Europe
For a teacher in Lisbon or a parent in Warsaw, ChatGPT will not vanish on 1 September. What changes is the Commission’s power to demand risk assessments and algorithm explanations from a US consumer AI service that now functions as search at continental scale. Henna Virkkunen, the EU executive vice-president for tech sovereignty, security and democracy, said the designations mean ChatGPT, Reddit, and Roblox will be held to a higher standard of scrutiny and accountability, matching their large impact on citizens and society.
That Brussels hook matters in every member state. Schools, parents, and election officials in France, Germany, Italy, Spain, Poland, and smaller countries now have a clearer path to argue that chatbot search results, Reddit ranking, or Roblox recommendations create systemic risk. Advertisers inside the single market should expect tighter targeting limits on these three properties. Product teams at OpenAI should not confuse this file with a ChatGPT feature sunset such as the official DALL-E GPT retirement; the chatbot stays live, under a heavier European search-engine rulebook.
The geographic story is also a market-access story. US services that already treat the EU as a single product region must now staff DSA Very Large work alongside AI Act work, with documentation that can be shown to the Commission. Companies that hoped chatbot search would stay in a lighter bucket lost that argument on 31 August 2026. The 45 million threshold, not a cultural debate about whether ChatGPT “feels like Google,” is what moved the file.
What OpenAI and platforms must do next
Secondary reports disagree on the last day of the grace period. Roth wrote that the three services have until the end of December 2026. Politico described a four-month window, which, counted from 31 August, lands nearer late November 2026. Compliance calendars should plan to the earlier four-month reading until the Commission’s designation letters settle the date. Missing the extra duties can cost up to 6 percent of worldwide annual turnover — a number large enough to matter even to OpenAI, Reddit, and Roblox’s parent economics.
The work is both legal and product-shaped: write systemic-risk files covering minors, mental health, illegal content, elections, and public security; restrict ad targeting as the DSA requires; and document how ranking and recommendation systems operate. File this story as policy-regulation news dated 31 August 2026. ChatGPT is now a Very Large Online Search Engine in the EU, Reddit and Roblox are Very Large Online Platforms, 28 services sit under the strictest DSA layer, and the AI Act still applies to OpenAI in parallel. The chatbot is not being banned; it is being treated as search-scale infrastructure.
